EU: Trouble for Irish copyright law
The EC is to refer Ireland to the European Court of Justice for its failure to communicate any national measures transposing Directive 92/100/EEC on rental right and lending right and on certain rights related to copyright in the field of intellectual property. The Directive is regarded by the EC as a key measure for completion of the single market in works and other subject matter protected by copyright and related rights, such as books, films, videos and sound recordings. The Directive harmonises rental right and lending rights for such works and subject matter and confers on authors (including the principal directors of films), performers, phonographic producers, producers of films and broadcasters the exclusive right to authorise or prohibit rental and lending. It also harmonises at Community level, for the same groups of right holders, the rights of fixation, reproduction, broadcasting, communication to the public, and distribution.
