Newspaper Society Launches Advertising Guide

The Newspaper Society has launched an online guide to key areas of advertising and marketing law, in an effort to help its members avoid falling foul of the laws regarding press advertising, and incurring subsequent legal costs.

Advertising Points To Watch uses checklists to help identify copy content issues on subjects as diverse as betting and gaming, body piercing, pyramid selling and sexual services. It will be updated on a regular basis, and also features key legal and self-regulating guidance on the Data Protection Act (1998), Consumer Protection (Distance Selling) Regulations (2000), the Competition Act (1998), sales promotion laws, competitions and lotteries and intellectual property law, contract formation and terms and conditions.

Santha Rasaiah, director of the Society’s Political, Editorial and Regulatory Affairs department, commented: “Advertising Points to Watch will be an invaluable tool for anyone who has the responsibility for deciding whether to accept an advertisement or sales promotion for publication, and their legal advisors.”

With the World Cup on a lot of minds at the moment, Points to Watch has highlighted the possible problems associated with the use of registered trade marks and logos, especially those owned or associated with FIFA. It also covers the developing law affecting use of the names and images of players and their clubs.
