Broadcasters Receive New Fairness And Privacy Code

The Broadcasting Standards Commission has published a new code of guidance for broadcasters relating to issues of fairness and privacy. The code may have signalled the end of documentary makers’ rights to film in secret if the BSC had decided to clamp down hard following Princess Diana’s death. However, the Commission has reached a compromise by tightening restrictions of filming and photographing whilst retaining a clause which allows strong investigation in matters of an ‘overriding public interest in the disclosure of the information.’ It is believed that the Press Complaints Commission will adopt a similar framework.

The BSC code is statutory, whereas the press restrictions are voluntary.
