Virgin TV, one of the unsuccessful bidders for the Channel 5 licence, has said it has very real concerns about the way the judgement went. Various partners within the consortium are still deciding with legal counsel what action may be taken. The next meeting of the Virgin TV board is on Monday, so no action will be taken until then.
The concerns centre around financial details which the bidders supplied the ITC with upon request in June. Under the C5 rules, account material supplied after the initial bid is not allowed to alter the proposal; Virgin TV is concerned C5 Broadcasting may have been allowed to enhance its application.
