ITC Gets Backing Over Unbundling
The Independent Television Commission has gained backing from the High Court over its ‘unbundling’ rule. The TV company Flextech’s challenge of the ITC’s ruling earlier this year, which claimed that the commission was acting outside of its legal powers (see Newsline), failed when the ITC received backing from the High Court..
The ITC’s proposed unbundling plans involve the removal of minimum carriage requirements (MCR’s) for cable and satellite channels (see Newsline). The BBC television channels which are distributed across pay-TV networks will be exempt from channel bundling restrictions.
Chief executive of the ITC, Peter Rogers, commented on the development: “The ITC welcomes the decision. The outcome of the judicial review reinforces the ITC’s interpretation its competition powers and the way in which it applies them. This enables the ITC to continue to take decisions with the viewer at the forefront of its mind.”
