The Independent Television Commission has issued a defensive statement regarding Virgin TV’s successful application for a judicial review of the Channel 5 decision. ITC has made it clear that this decision is based on evidence provided to the court by Virgin only, and at this stage is not based on merits of the case but the court is “only concerned at this stage to weed out the hopeless cases”.
The ITC points out that contrary to reports, there has not been any judicial criticism of the ITC; “Leave was granted on grounds which are entirely usual in this area of law.”
The ITC says it is preparing evidence to refute the allegations made against it by Virgin; the case is expected to be heard in January.
