Following legal advice that ITV is actually within its rights to move the News At Ten, senior ITV executives want the powers and responsibilities of the ITC to be tested in court.
A judicial review in the High Court seems to be the only way to decide if the ITC has the power to control the time of a particular programme. It is not only the issue of timing in dispute but also ITV’s obligation to provide a diverse schedule. Such a confrontation now looks likely, after Greg Dyke, Chairman of the ITV Association has said that the 1990 Broadcasting Act is too ambiguous on the powers of the ITC.
