Oftel Publishes New Rules For Communications Regulation

Oftel has published the new draft regulatory framework for the electronic communications sector, as set out in the Government’s draft Communications Bill (see The Bill In Brief: The Changes To Come).
The regulations, which replace the obligations contained in current telecoms licences, are intended provide a more streamlined regime for service providers and set out the requirements that operators will need to meet in order to provide communications networks and services.
The requirements cover the inclusion of specific terms in contracts, procedures to resolve customer complaints and the provision of certain “necessary” services. Operators will also be obliged to provide “reliable” network systems and under a “must carry” condition may be required to carry specific channels or programmes.
The conditions will be backed by powers to fine companies up to ten percent of their turnover if they breach the regulations when the Communications Bill becomes law in June 2003.
Oftel’s director of communications, Dave Edmonds, said: “The new system with its single set of duties and obligations will guarantee universal service, consumer protection and network reliability.”
He added: “The new conditions will establish a framework for interconnection and access, which is a key building block to create competitive markets.”
