Second Channel 5 Challenge Begins Today
The second challenge to the Channel 5 licence award begins in the High Court today, with UKTV accusing the ITC of allowing the winner to enhance its bid after the applications were submitted.
UKTV will argue that it was unreasonable and illegal for the ITC to allow such enhancement, while the ITC is likely to insist that it only sought clarification of the level of the Channel 5 Broadcasting financial commitment. If UKTV gains the right to a full judicial hearing it will ask to have its case joined with Virgin, whose case will be heard on January 17.
