Virgin To Challenge ITC

Virgin Television has won the right to challenge the ITC’s decision to award the Channel 5 licence to Channel 5 Broadcasting. A High Court judge has today ruled that the ITC’s decision was flawed by “illegality, irrationality and procedural impropriety.” The challenge will be heard in the High Court in the new year.

The original shareholders in Virgin Television were Paramount, Virgin, Associated White Rose, Electra, HTV and Philips. HTV and Philips, who are already ITC licence holders, have agreed to transfer their shares to the remaining shareholders. Associated, who are also an ITC licence holder, are to sell their minority stake in Associated White Rose to White Rose.
