Virgin Television has this morning in the High Court accused Channel 5 Broadcasting of illegally changing its bid after the final submission. All bidders had to put forward a business plan containing detailed funding plans; the ITC wrote to C5B regarding their business plan. C5B subsequently added £100m to their funding proposal after the submission of the final bid, said Virgin TV today.
New Century and UKTV both put forward summaries of their views of the case this morning; New Century pointed out that they were the only other applicant to pass the quality threshold, and should therefore be awarded the licence if it is denied to C5B. UKTV, the highest bidders are demanding a whole new bidding round should the ITC decision be challenged by the courts.
Virgin TV will continue to put its case in the hearing after lunch.
