Virgin TV Confirms Legal Action
Virgin TV, one of the unsuccessful applicants for the Channel 5 licence has confirmed that it is to mount a legal challenge over the award of the licence. The group issued the following short statement: “On the basis of robust legal advice from Anthony Scrivener QC, the directors of Virgin Television have decided to move to judicial review proceedings over the decision by the ITC on Channel 5.”
Virgin TV, which bid £22,002,000, an identical sum to the winning Channel 5 Broadcasting, lost out on failing to reach the quality threshold, as did the highest bidder, UKTV. Virgin TV in particular was criticised in terms of its limited range of programming suppliers and insufficient staff for its news service. UKTV has said it will not be seeking judicial review over the decision.
The Independent Television Commission has never yet been successfully challenged over its decisions.
