TSW Loses Judicial Review

The Court of Appeal has today refused, by a 2 to 1 majority, to quash the ITC’s decision to reject TSW’s franchise application.

The Court of Appeal said that, while it recognised the shortcomings in the manner manner in which the ITC dealt with the auction process, it did not feel these were sufficient to justify quashing the ITC’s decision.

TSW’s managing director, Harry Turner, responding to the announcement, said that he was extremely disappointed by the ruling and that he remains convinced that TSW’s bid was viable and sustainable. Turner went on to say that the company will continue to provide its current quality service until the franchise expires at the end of the year.
