TSW’s attempt to seek a judicial review of the ITC’s decision to award its licence to WestCountry failed yesterday when the High Court ruled that the argument was “doomed to inevitable failure”.
TSW hit out yesterday by complaining that the ITC had “moved the goalposts”, imposing more rigid tests than the applicants had been led to believe.
TSW’s fate seems likely to deter other companies considering judicial review, although TVNi, which failed the quality test and was defeated by Ulster TV, is now understood to be preparing to take the matter to court.
