Defeated franchise bidders TVS and TVNi have failed to secure a judicial review of the ITC’s decision to award the licences to other applicants.
TVS and TVNi were told in the Appeal Court that they had procrastinated too long before deciding to challenge the ITC, during which time Meridian (winner of the South/South East franchise) had instigated a rights issue, and Ulster Television had continued its programme of investment.
The announcement comes despite the fact that, in theory, the law allows the companies until 16 January to mount a legal challenge…. TSW is the only applicant so far to have succeeded in obtaining leave to bring a judicial review.
TVS and TVNi have yet to confirm whether they will seek permission from the law lords to appeal against this latest decision.
